Viruses

We do not guarantee that our site will be secure or free from bugs or viruses.

Applicable law

You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Acceptable Use Policy

This Acceptable Use Policy sets out the terms between you and us under which you may access our website www.nhs.uk/start-for-life (our site). This acceptable use policy applies to all users of, and visitors to, our site.

Your use of our site means that you accept, and agree to abide by, all the policies in this Acceptable Use Policy, which supplement our terms of website use.

Prohibited uses

You may use our site only for lawful purposes. You may not use our site:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards, please see our Content Standards section below.
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojans, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:

  • Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of our Terms of Website Use.
  • Not to access without authority, interfere with, damage or disrupt:
    • any part of our site;
    • any equipment or network on which our site is stored;
    • any software used in the provision of our site; or
    • any equipment or network or software owned or used by any third party.

Interactive services

We may from time to time provide interactive services on our site, including, without limitation:

  • Chat rooms
  • Bulletin boards

Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks.

However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

The use of any of our interactive services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not fool proof.

Minors who are using any interactive service should be made aware of the potential risks to them.

Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

Content standards

These content standards apply to any and all material which you may contribute to our site (contributions), and to any interactive services associated with it.

You must comply with the spirit and the letter of the following standards. The standards apply to each part of any contribution as well as to its whole.

Contributions must:

  • Be accurate (where they state facts)
  • Be genuinely held (where they state opinions)
  • Comply with applicable law in the UK and in any country from which they are posted

Contributions must not:

  • Contain any material which is defamatory of any person
  • Contain any material which is obscene, offensive, hateful or inflammatory
  • Promote sexually explicit material
  • Promote violence
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age
  • Infringe any copyright, database right or trade mark of any other person
  • Be likely to deceive any person
  • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence
  • Promote any illegal activity
  • Be threatening, abusive or invade another's privacy, or cause annoyance, inconvenience or needless anxiety
  • Be likely to harass, upset, embarrass, alarm or annoy any other person
  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person
  • Give the impression that they emanate from us, if this is not the case
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse

Suspension and termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this Acceptable Use Policy constitutes a material breach of the Terms of Website Use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site
  • Issue of a warning to you
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach
  • Further legal action against you
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

Changes to the Acceptable Use Policy

We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our site.

Competition

Better Health Start for Life prize draw terms and conditions

  1. The prize draw is open to all residents of the UK aged 18 years or over who are signed up to the Better Health Start for Life email programme (Programme) and complete a survey (see condition 3), except employees of the Promoter, their families, agents or any third party directly associated with administration of the prize draw.
  2. The prize draw is free to enter, and no purchase is necessary.
  3. All entries must be submitted by completion of the survey contained in a standalone email of the Programme (Survey) and only 1 entry per household is permitted. You will be automatically entered into the prize draw on completion of the survey (unless you email betterhealth-startforlife@dhsc.gov.uk stating that you wish to opt out).
  4. The Survey must be taken on receipt of the Survey email not before 00:01 on 14 March 2024 and not after 23:59 on 11 April 2024. Surveys received after this time will not be entered into the prize draw.
  5. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind. The Promoter accepts no responsibility for any Surveys that are not completed for any reason.
  6. A total of 15 winners will be chosen by random draw performed by a computer process on 25 April 2024. Answers given on the Survey do not affect the outcome of the draw.
  7. Each winner will receive an £80 shopping e-voucher/e-gift card, to be provided by a third party (and they may be directed to a third-party website and/or be required to provide their email or other contact details in order to receive the voucher). Shopping vouchers are subject to the terms and conditions of the chosen retailer.
  8. The winners will be notified by email (using details provided at entry) before 9 May 2024. The winners must choose their retailer preference and submit it within 14 Days from the day that they will receive an email confirming that they are winners. The retailers provided for the option of the gift card are; Tesco, ASDA, Sainsbury's and Waitrose. If a winner does not respond to the Promoter within 14 days of being notified by the Promoter, then the winner's prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described in condition 6.
  9. The prizes will be sent to the winners via email within 3 working days of them having submitted their retailer preference and claimed their reward. The £80 gift card Terms and Conditions will be shared directly to the winner once they choose and submit a retailer of their choice from the options provided above.
  10. The prizes for the winners are non-exchangeable, non-transferable and no cash alternative is offered.
  11. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
  12. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
  13. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable, copies of their winning entries, to anyone who emails betterhealth-startforlife@dhsc.gov.uk or writes to:

    Enclose a self-addressed envelope within 1 month after the closing date stated in condition 4. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at betterhealth-startforlife@dhsc.gov.uk. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  14. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions.
  15. The Promoter reserves the right to hold void, cancel, suspend or amend the promotion where it becomes necessary to do so.
  16. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize, except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  17. Personal data supplied during the course of this promotion will only be processed as set out in the Promoter's privacy policy. See also condition 13 with regard to the announcement of winners.
  18. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
